Man Charged With Running Over And Killing Arkansas Teen

May 7, 2012

According to FOX 16 News, the family of a slain boy is intent on seeing a man pay for causing what could be considered the wrongful death of their loved one.

The incident occurred Thursday afternoon at the Asher 1 Stop near the intersection of Asher and Maple Streets. The 58-year-old man held responsible for the death stated that he was at the location to cash a check after having a gun stolen from his room at a local motel. He then told police that when he saw the boy and his friend, he offered them $1,300 if they could help him retrieve his stolen weapon. That’s when the boy snatched the man’s wallet from his vehicle and then rode away on his bike. The man gave chase in his van and the pursuit began.

The chase ended on a hill in a vacant lot near 17th and Oak. The man hit the boy with his van and ran him over. He then stopped the vehicle, pulled the boy out from underneath the van and began beating him and demanding his money back. He was only stopped by the arrival of police.

The Arkansas Personal Injury Lawyers with Rainwater, Holt & Sexton would like to send their condolences to the family of the young boy. No matter what the circumstances are, there’s no excuse for taking the law into your own hands and causing a potential Arkansas Wrongful Death .

Little Rock Worker Killed After Being Electrocuted By Power Lines

April 9, 2012

The Bureau of Labor Statistics reports that construction work is one of the most dangerous occupations in the country. An estimated 780 workers died from preventable accidents while working in the industry in 2010 alone.

The most recent accident that claimed a life occurred last week in Little Rock, Arkansas. According to reports released by FOX 16 News, the incident occurred Friday as two men worked to install aluminum siding on a home.

Officers with the Little Rock Police Department stated in reports of the incident that the 25-year-old man was working with a partner to move a ladder outside a home on Chambery Drive when the 30-foot metal climbing device tipped back and made contact with nearby power lines. The contact allowed a powerful electric current to travel through the ladder and into the worker’s body. The shock sent the man falling to the ground where he laid unconscious until paramedics arrived. They transported him to a local hospital, but were unable to resuscitate him. He was declared dead shortly after arrival at the facility.

The Arkansas Wrongful Death Lawyers with Rainwater, Holt, and Sexton know just how dangerous exposed electric currents can be. That’s why they say that workers should be extra vigilant around power lines. Also, cover all exposed electric outlets if you have children in the home, and if someone is electrocuted, contact 911 for medical assistance immediately.

The 99 Makes Its Way To Benton, Arkansas Through March

March 12, 2012

A new way of educating teens and young adults about the dangers of risky behaviors, including drug use and drinking and driving, has come to Benton, Arkansas. According to FOX 16 News, the 99 Walkthrough Reality Theatre has been set up at 121 Alcoa Rd. since March 2 and will remain there until the end of the month.

Participants of The 99 will walk through five different scenarios being played by live actors. Each scene portrays how a different teen’s choice to participate in risky behavior ultimately leads to his or her demise.

The idea behind the reality theatre is based on the Centers for Disease Control and Prevention’s statistic that 99 young people in the country die in car accidents or from drug overdoses, domestic violence, homicides, and suicides each day.

The director of The 99, Terry Henshaw, says he hopes the program will help teens realize their decisions have consequences and that “when they see the reenactments, they’ll make better choices.”

One teen who walked through the program said it was “eerie” and thought provoking.

The 99 will be open Friday through Sunday from 7:00 p.m. to 11:00 p.m. until the end of March and will be in Louisville, Kentucky, from April through May.

The Arkansas Car Accident Lawyers with Rainwater, Holt and Sexton would encourage all young adults and teens in those areas to check this event out and see the dangers of risky behaviors firsthand.

Arkansas State Police Announce Start Of Anti-Drunk Driving Campaign

March 5, 2012

The Arkansas State Police announced yesterday that this week would mark the beginning of a statewide anti-drunk driving campaign aimed at teens. The agency stated that the campaign would run from March 9 through March 18. Then, from April 13 through April 22, officers will focus enforcement on intoxicated teen drivers.

Authorities say they chose those dates to coincide with the large number of student events scheduled for that time of year that’s known to be associated with teen drinking, such as spring break, proms, and graduation.

State troopers, sheriff’s deputies, and police officers from across the state will conduct saturation patrols and sobriety checkpoints in an attempt to lower the number of alcohol-related teen fatalities in the state this year. In 2010, 47 teens were killed in alcohol-related accidents.

Law enforcement warns teens that they can be arrested for driving under the influence if their blood-alcohol content (BAC) is between .02 and .07 percent. A BAC of .08 percent or higher constitutes the more serious offense of Driving While Intoxicated (DWI).

Offenders can expect a sentence of possible jail time, fines of around $2,000, driver license suspension, and mandatory community service.

The Arkansas DUI Accident Attorneys with Rainwater, Holt & Sexton encourage all drivers to do their part in keeping Arkansas’s highways safe by not getting behind the wheel after consuming alcohol. Instead, call a cab or a trusted friend to get you home safely.

Drunk Driver Sentenced To 22-Years For Fayetteville Crash

January 30, 2012

Drunk driving can not only destroy the lives of accident victims, but their families and loved ones as well. FOX 16 News reported from a courtroom today where the parents and fiance of two drunk driving victims gave testimony on the impact their loss has had on their lives during the sentencing of the drunk driver responsible for the crash.

The accident happened on May 15th of last year on I-540 in Fayetteville, Arkansas. It is there that the drunk driver, with a blood alcohol content of .16–or twice the legal limit–hit the vehicle driven by the 26-year-old woman. A passenger in the woman’s car died at the scene, and the driver died three days later at a local hospital.

The driver responsible for the crash pled guilty to two counts of negligent homicide and was sentenced to up to 22 years in prison.

While a lengthy prison sentence may ensure the drunken driver doesn’t commit the crime again for quite a while, it does not compensate for the loss the victims’ families have suffered. In order to be awarded damages for the accident such as lost income, expenses, and other punitive damages, a civil case must be brought against the drunk driver.

The Arkansas wrongful death attorneys with Rainwater, Holt & Sexton are here to help you if you have any questions regarding the loss of your loved one because of another person’s negligent act. Contact an experienced attorney today for a free initial consultation.

Campaigns to Eliminate Distracted Driving in Arkansas

January 23, 2012

A new campaign called The Great Hang Up is sweeping across the country The aim of the program is to eliminate distracted driving accidents caused by talking and texting on cell phones on America’s highways. According to Arkansas’s THV 11 News, the campaign asks that drivers sign a pledge to not operate a cell phone while behind the wheel of a moving vehicle.

To participate, sign a pledge sheet and keep it in your car as a reminder to the promise you have made yourself. Then, stay focused behind the wheel by following the sheet’s simple distraction eliminating guidelines.

The Better Business Bureau (BBB) is also trying to bolster efforts to end distracted driving by creating their own campaign called Faces of Distracted Driving. The group has created a website with videos that show the impact distracted driving accidents have on ordinary people and their families.

While Arkansas legislators are pushing for better laws to protect motorists from distracted driving, thousands will still be hurt or killed in the state until the ramifications of the accidents the activity can cause are understood by a majority of citizens.

This is why the Arkansas distracted driving accident lawyers with Rainwater, Holt & Sexton would like to urge drivers to take a closer look at both of these programs and think about participating. Reducing the risks that distractions impose on drivers is the simplest way to eradicate a growing problem that could leave you injured.

Arkansas Farm Worker Killed While Working In Grain Bin

January 16, 2012

A 56-year-old Arkansas farm worker died suddenly last Friday morning after falling into a grain silo. According to reports from KTHV News, the man fell at around 11:00 AM at Parker’s Farms on Miller Road in Lonoke County.

A press release from the Lonoke County Sheriff’s Department stated that witnesses saw the victim on top of what farmers refer to as “The Bridge”–or a dome of grain that has formed an empty space beneath it. The victim was attempting to break up the bridge in order to clear a blockage, when suddenly it gave way beneath him, burying him beneath the falling grain. Rescue workers found the victim at approximately 12:15 PM and pronounced him dead at the scene.

Grain bins can be extremely dangerous and were responsible for a record number of worker deaths in 2010. According to a study from Perdue University, 51 workers died of suffocation related to grain bins, up from 38 the year before. In response to the growing number of deaths, the Occupational Safety and Health Administration (OSHA) now requires that all farmers working with grain bins must wear a special safety harness with a lifeline on it.

The Arkansas wrongful death attorneys with Rainwater, Holt & Sexton know that employers have a responsibility to keep workers safe on the job. Call us today if your loved one suffered a wrongful death in a preventable farm accident.

Migraine Medication Might Put Heart Health at Risk

January 2, 2012

Those who suffer from migraine headaches know that there is little to be done to stop the constant pounding once it starts. So, when you find a pain reliever that works, you stick with it. However, a recent study shows that a surprising number of patients who suffer from migraines are being prescribed medications they shouldn’t take because of heart conditions they also suffer from.

The findings were reported late last month by FOX 16 News and show that one in five patients with heart conditions who also suffer from migraines were given prescriptions for a class of drugs called triptans. These triptans are very effective in treating migraines and work by constricting blood vessels up to 20 percent. This constriction could cause a person with a history of heart issues to suffer any number of pulmonary problems, bust most commonly heart attacks and strokes.

Researchers pinpointed more than 120,000 patients who suffered form migraines from ten different insurance providers. Data collected from these cases determined that eight percent of all the patients suffered form both migraines and heart conditions. Of those patients, 22 percent had received prescriptions from doctors for triptans.

Some of these Medications include:

  • Amerge®
  • Axert®
  • Frova®
  • Imitrex®
  • Maxalt®
  • Relpax®
  • Treximet®
  • Zomig®

The Arkansas drug injury lawyers with Rainwater, Holt & Sexton suggest that anyone taking these medications that has a history of heart conditions to consult with your doctor immediately. If you have suffered from a heart complication while taking one of these medications, we suggest you contact us today.

Arkansas Receives Four Stars For Efforts Against Drunk Driving

November 21, 2011

Arkansas is doing more than most states to combat drunk driving according to a new report released by the advocacy group, Mothers Against Drunk Driving (MADD). According to the report released last Wednesday, the state received four out of five stars on a national report card that evaluated each state’s drunk-driving countermeasures.

The report was released in conjunction with the group’s fifth anniversary of the Campaign to Eliminate Drunk Driving®, and reviewed what each state was doing to combat drunk driving. Arkansas received it’s rating for:

  • Conducting sobriety checkpoints
  • Having enhanced penalties for those who drive drunk with children in the car
  • Requiring ignition interlocks for all convicted drunk drivers
  • Using administrative license revocation for drunken driving offenders

The state would have received a five star rating if they would have taken part in “no refusal” checkpoints that allow officers to receive warrants on-site for blood samples from drivers who refuse to submit to testing.

MADD’s report also offered updated figures for the cost of drunk driving to American taxpayers. They say accidents caused by intoxicated drivers cost Americans $132 billion annually.

The Arkansas Auto Accident Attorneys with Rainwater, Holt & Sexton are encouraged by the MADD’s assessment of Arkansas. If you have been injured in an drunk driving accident at no fault of your own, you may not know what to do. Recently, founding attorney, Mike Rainwater, spoke about what to do to protect yourself after a crash.

Conway Police Crack Down On Under Age Drinking

November 14, 2011

Just weeks after a similar operation, the Conway Police Department conducted an undercover sting at area restaurants on underage drinkers. According to FOX 16 News, out of eight establishments checked for compliance, five failed.

Police sent an underage informant into establishments across town with unaltered identification to attempt to purchase alcohol. A server at Ruby Tuesdays served the 19-year-old without checking identification, while bartenders and wait staff at Michelangelo’s, US Pizza, Bear’s Den, and Cactus Jacks checked the boys ID yet served him anyway. In all, 21 businesses have been visited and 11 have failed. All those who served the underage individual were issued fines ranging from $200 to $500.

Police say they hope the sting will help combat the growing problem of underage drinking in Arkansas. A 2005 Arkansas Prevention Needs Assessment found that 22.9 percent of all Arkansas 6th, 8th, 10th, and 12th graders had used alcohol in the 30 days prior to the survey with the average age of teenage users being 14. More than a quarter of 12th graders reported binge drinking in the last two weeks, most of who reported drinking at a friends house. These drinking episodes away from home put the teens at a higher risk of drunk driving accidents.

The Arkansas Car Accident Lawyers with Rainwater, Holt and Sexton often handle cases where injured victims have been involved in an accident with a drunk driver. Founding attorney, Mike Rainwater, recently discussed how to protect yourself after an accident if you have been injured in a recent interview.
