Truck Driver Crushed To Death In Lot Of Arkansas Processing Plant

August 8, 2011

A truck driver working for the meat giant, Tyson Foods, was killed last Wednesday on the lot of the company’s Berry Street plant in Springdale, Arkansas. According to Fox 16 News, the 50-year-old driver was found pinned between the back of his truck’s trailer and another trailer around 11:00 PM.

The detective in charge of the case for the Springdale Police Department, Lt. Kevin Lewis, said that when an employee found the driver pinned between the two trailers and tried to move the front unit forward, he noticed the brakes had not been properly set. Local authorities, along with federal officials and Tyson, are investigating the incident to determine exactly what happened.

Occupational Safety and Health Administration (OSHA) spokesperson, Juan Rodriguez, stated the agency had began an investigation into the incident and it could take OSHA up to six months to full complete the investigation. OSHA has jurisdiction over off-highway loading and unloading of big trucks and has very stringent guidelines as to what plants must do in order to stay in compliance with the regulations of loading and unloading a truck.

Arkansas Boy Hit and Killed by Car While Riding Scooter

August 1, 2011

A 13-year-old boy was killed after being struck by a car while riding scooters with a friend in Fort Smith, Arkansas. According to 4029tv.com, the accident occurred on Meandering Way, around 6:45 PM Sunday evening.

The driver involved in the crash told investigators he was traveling south when the two boys ran through a stop sign at an intersection in the road. He said he did not see the boys until it was too late, and was unable to stop his Saturn SUV in time. The boy was transported to St. Edward Mercy Medical Center, and was pronounced dead at approximately 9 PM.

There are several ways parents can keep their children safe while riding scooters:

  • Always Wear A Helmet And Safety Gear- In most places, this is required by law; it could eliminate up to 2/3 of injuries resulting from a crash.
  • Always Supervise Children Under Eight- 1/3 of all scooter accidents involve children in this age category. Children at this age may not have the strength, coordination, and judgment needed to handle a scooter alone.
  • Obey The Rules of the Road- Scooter riders must obey the same rules as bikers, including stopping at all stop signs and red lights, signaling turns, and obeying traffic signs.
  • Do Not Ride A Scooter At Night- Cars cannot see you!

The Arkansas Personal Injury Attorneys with Rainwater, Holt & Sexton encourage parents to keep children safe by teaching them to follow these simple rules when on their bike, scooters, or skateboards.

Several Boaters Injured After Accident on Arkansas Lake

July 25, 2011

Victims of a boating accident on Lake Ouachita near Hot Springs, Arkansas, are pointing fingers at the Army Corps of Engineers for a missing buoy that caused a boat to run aground on rocks just below the surface.

Channel 7 News reported that the accident occurred last Thursday while a boater took some friends and their kids out on her boat. There were eight people on board as the craft made its way past Hotel Island en route to Bird Island. The vessel was clipping along at 30 mph when it struck a submerged rock island in the middle of the lake, according to one witness. The boat ran aground and came to an abrupt stop. The impact tossed two from the boat, and all others sustained cuts and bruises. A child on an inner tube behind the boat required crutches for injuries received from the crash.

All swam to shore and were met by officers, along with fire and rescue squads. Officials told the boat’s owner there was a buoy at the crash site, but it had become loose and had been lying on a nearby shore for over two weeks. The Army Corps of Engineers is denying responsibility, saying they don’t put buoys in shallow water areas.

Stanley Reed Killed in Single Car Accident

July 18, 2011

According to Arkansas News, a prominent Arkansas leader was killed Friday in a single car crash along US Highway 64 in Woodruff County. Stanley Reed, 59, was traveling along the roadway when his car veered off the road for an unknown reason. The vehicle crossed a ditch and struck a tree some 300 feet off the road. Reed was pronounced dead at the scene of the crash. State police indicated in their report that there were no signs of Reed attempting to stop the vehicle before the crash, as there were no skid marks on the roadway at the scene. This leads investigators to believe Reed either had a medical emergency behind the wheel or was distracted at the time of the crash.

Can a driver be held responsible for injuries and property damage if they pass out behind the wheel? Many states have what is called a sudden-emergency defense, in which the driver is not held responsible for the accident if they had no knowledge of the condition that caused them to blackout behind the wheel and have the burden of proof to show a medical condition caused the blackout.

If you know of someone who was involved in an accident with a person who lost consciousness behind the wheel, or have blacked out yourself, contacting an Arkansas Car Accident Attorney with Rainwater, Holt & Sexton could be a very wise decision. They may be able to help you settle your case against the insurance company.

Lonoke County Plane Crash Kills One

July 11, 2011

Many unanswered questions remain following a plane crash involving an ultra-light aircraft in western Lonoke County. According to Fox 16 News, the aircraft went down near Bearskin Lake, east of North Little Rock, Arkansas, at just after 1:30 PM Saturday.

The pilot was seen around 11:30 AM flying normally around in the area. Two hours later, farmers noticed the plane going down near a bean field, for reasons unknown. They ran to the site and found the plane upside down and the pilot still inside, with no pulse.

Officials say that a parachute deployed, but were not able to determine the time at which the cord was pulled. They have indicated that the Federal Aviation Administration (FAA) will conduct further investigation to clarify that detail.

The pilot has been identified as a 44-year-old man from Little Rock, Arkansas.

The FAA has started a full investigation, which authorities believe will lead to more answers concerning the cause of the accident.

If an aircraft part was faulty or not working properly, or if the parachute malfunctioned because of a problem that was no fault of the pilot’s, his family may have the right to compensation for the wrongful death of their loved one. An Arkansas Wrongful Death Attorney with Rainwater, Holt & Sexton may be able to help families victims in determining whether fault can be shown in cases such as this one. Pain Therapy Problems Examined in New Study

July 4, 2011

According to a report issued by the Institute of Medicine, an estimated 116 million adults in the United States suffer from long-lasting pain conditions, more than the number of patients affected by heart disease, diabetes, and cancer combined. The report claims that the real problem is the way pain conditions are treated throughout the entire health industry.

There seem to be two extremes in the medical profession when it comes to the treatment of patients suffering from pain: doctors who ignore patient claims because of fear they are merely drug seekers, and those who over-prescribe heavier-than-needed medications and doses to patients who could benefit from a more holistic approach.

The report includes numerous testimonials from patients who paint vivid pictures of the complacency doctors showed toward claims of suffering from debilitating pain. A nurse wrote of the many patients she had seen who could have benefited from a simple treatment, but were referred to specialists too late, after the problem had compounded past the point of said treatment.

On the other hand, both patients and physicians expressed feelings of being treated like common criminals by authorities and their State Board of Medical Examiners for taking and prescribing opioid-based pain medications. Both sides gave attested to being questioned heavily regarding the need of certain medications to treat patient conditions.

If you have suffered because of negligent treatment or over-treatment for pain, the Arkansas Drug Injury Lawyers with Rainwater, Holt & Sexton are here to help you receive the compensation you deserve.
